04/20.11.2019 The present writ petition has been filed for quashing letter No. 245 dated 25.02.2010 (Annexure-3 to the writ petition) issued by the respondent No.3 addressed to the Regional Transport Authorities of Ranchi, Dhanbad and Jamshedpur not to grant/issue permit to auto rickshaw or Private Public Service Vehicle for the earmarked roads in the said cities in terms with Section 113 of the Motor Vehicle Act, 1988.
No one appears on behalf of the petitioners whereas learned A.C to G.P-I
is present on behalf of the respondents.
A counter affidavit has been filed on behalf of the respondent No.2 stating inter alia that the direction given by the respondent No.3 vide letter No. 245 dated 25.02.2010, has subsequently been withdrawn vide letter No. 1323 dated 26.08.2010, a copy of which has been annexed as Annexure-A to the said counter affidavit.
In view of the said fact stated in the counter affidavit filed on behalf of the respondent No.2, I see no reason to proceed further with the present writ petition.
The present writ petition is accordingly dismissed.
