Perused the material brought on record. Since the offending bus bearing registration no. JH02J-8464 registered in the name of Manjeet Kumar met with an accident with Alto car bearing registration no. JH01AL-4574 registered in the name of Ashok Kumar Tiwary. The Bus bearing registration no. JH02J-8464 was not duly insured before the New India Assurance Company Limited on the date of accident as the period of insurance was 24.04.2012 to 23.04.2013 whereas the accident took place prior to that on 18.04.2012, as such, the vehicle was not validly insured before the New India Assurance Company Limited. So far the another vehicle i.e. Alto car bearing registration no. JH01AL-4574 is concerned, the same is insured before the M/s IFFCO TOKIO General Insurance Company Limited for the period 04.04.2012 to 03.04.2013 which covers the date of accident, as such, the Tribunal has rightly awarded ad interim compensation in favour of the claimant against the Insurance Company of the Alto Car. The order passed by the learned Tribunal is to be merged in the final order passed under section 166 of the M.V. Act, as such, no case is made out by the appellant to interfere with the impugned liability fasten upon the appellant IIFCO TOKIO General Insurance Co. Ltd. So far the interest is concerned, it appears that in view of judgment of Dharampal (supra) , the interest ought to have been 7.5% from the date of filing of the application, as such, the same is reduced from 9% to 7.5% from the date of filing of the application till its realization.
