“This appeal is directed against the order dated 10.04.2019 passed in S.T. No.193/2017 by the court of learned Addl. Sessions Judge – I – cum – Spl. Judge SC/ST Act, Hazaribag whereby and whereunder the appellant’s prayer for grant of bail stood rejected, in a case arising out of Chouparan P.S. Case 15/2007; corresponding to G.R. Case No.383/2007, S.T. No.193/2017, registered under Sections 341/34, 323/34, 325/34, 307/34, 302/34 of the Indian Penal Code and 3(A)/4 of the SC/ST Act, and charge has been framed u/s 341/34, 323/34, 325/34, 307/34, 302/34 of I.P.C & U/s 3(2)(v) SC/ST Act 1989. The case is pending in the court of learned Addl. Sessions Judge – 1 – cum – Special Judge SC/ST Act, Hazaribag.”
4. The learned counsel for the appellant after some argument seeks permission to withdraw this case at this stage. 5. Accordingly, this petition is dismissed as withdrawn.
6. The provisional bail granted to the appellant vide order dated 03.07.2019 is hereby cancelled and the appellant is directed to surrender before the learned court below within a period of one week from today.
