Since, both the appeals arose from the same case, they are being heard together and disposed of by this common order.

The appellants have preferred these appeals under section 14A of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act being aggrieved and dissatisfied by the order dated 08.05.2019 passed by Special Judge, SC & ST ( POA), Palamau at Daltonganj in connection with Patan P.S. case no. 37/2019, whereby the bail petition of the appellants was rejected.

It appears that under order dated 03.07.2019 and order dated 24.06.2019 respectively the appellants were admitted on provision bail till 17.09.2019.

Further, office note dated 22.08.2019 reveals that notice was validly served upon respondent no.2 but no vakalatnama is filed on behalf of respondent no.2.

Case diary has been received.

Be that as it may, the provision bail earlier granted to the appellants is, hereby, Confirmed , subject to the condition that appellant Sanjiv Kumar Singh shall deposit Rs. 1000/- and appellant Dr. Manzoor Alam @ Md. Manzoor Alam shall deposit Rs. 1500/- in the account of Bandi Kalyan Kosh, Birsa Munda Central Jail, Hotwar, Ranchi being A/c No.490710210000007, Bank of India, Branch-Booty More, Customer ID103610460, IFSC Code no. BKID0004907 on or before the date of furnishing of their bail bonds and submit receipt in the trial court.

Accordingly, the Cr. Appeal (SJ) No. 566 of 2019 and Cr. Appeal (SJ) No. 595 of 2019 stand allowed.

Let a copy of this order be communicated to the trial court, the Superintendent of Jail, Birsa Munda Central Jail, Hotwar, Ranchi and the learned counsel for the parties.
