This criminal revision application has been filed to challenge the legality, propriety and correctness of the order dated 30.05.2018 passed in Misc. Crl. Application No. 77 of 2018, arising out of Dumka (A.C.B.) P.S. Case No. 04 of 2017, crossponding to Vigilance Case No. 07 of 2017, registered under sections 7/13(2) of the Prevention of Corruption Act, 1988, by learned Special Judge, (ACB), Dumka whereby and whereunder, an application dated 27.02.2018 preferred by the petitioner under section 239 of the Cr.P.C for discharge was rejected without considering the facts and circumstances of the case.
After some arguments, learned counsel for the petitioner seeks permission to withdraw this criminal revision application.
Permission is granted.
Accordingly, this criminal revision application is dismissed as withdrawn with liberty to the petitioner to raise all those points which has been raised in this application before the appropriate forum.
Let a copy of this order be sent to the concerned trial court and a copy of
this order be handed over to the learned counsel for the A.C.B.
