Learned counsel for the petitioner submits that this criminal miscellaneous petition has been filed to restore Cr.M.P. No.1283 of 2019 to its original file which was dismissed for non-compliance of the peremptory order dated 17.05.2019 whereby, the petitioner undertook to file a supplementary affidavit annexing therewith the copy of the documents showing that the victims namely Dolanti Mohli, Reena @ Hopan Mohli & Karmali Mohli have received Rs.36,000/- each and their signature or thumb impressions have been identified by the Assistant Public Prosecutor concerned.
The learned counsel for the petitioner drawing attention of this Court to annexure -2 series at page nos. 4 -7 of the supplementary affidavit dated 29.10.2019 submits that victims namely Dolanti Mohli, Reena @ Hopan Mohli & Karmali Mohli have received Rs.36,000/- each and their thumb impression has been identified by the Assistant Public Prosecutor concerned. It is then submitted that the petitioner has very good grounds to agitate in the criminal miscellaneous petition and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted the Cr.M.P. No.1283 of 2019 be restored to its original file.
Learned Addl. P.P. has no serious objection for the prayer of restoration of said criminal miscellaneous petition.
Considering the aforesaid submission of the learned counsel for the petitioner, Cr.M.P. No.1283 of 2019 is restored to its original file.
List Cr.M.P. No.1283 of 2019 after a week.
Accordingly, this criminal miscellaneous petition is disposed of.
