03 / 08.11.19 Heard the parties. Though notice was issued upon Opposite party nos. 2 to 5 but no one turns up on their behalf even after repeated calls.
Learned counsel for the petitioners submits that this criminal miscellaneous petition has been filed with prayer for restoration of Cr.M.P No. 1576 of 2019, which was dismissed for default of the petitioner. It is further submitted by learned counsel for the petitioner that when that case was called out, the counsel for the petitioner could not attend the court as his son was seriously ill, which resulted in dismissal of Cr.M.P No. 1576 of 2019. It is next submitted that the petitioner has very good ground to agitate in the said Cr.M.P No. 1576 of 2019 and unless the said Cr.M.P No. 1576 of 2019 is restored to file she will be highly prejudiced. Hence it is submitted that Cr.M.P No. 1576 of 2019 be restored to its original file.
Considering the aforesaid facts and circumstances of the case, Cr.M.P No. 1576 of 2019 is restored to its original file. List Cr.M.P No. 1576 of 2019 after a week under appropriate heading. This criminal miscellaneous petition is disposed of
accordingly.
