07/01.04.2019 It appears from the record that vide order dated 17.01.2019, Criminal Revision no. 198 of 2008 was ordered to be restored to its original file and stage, subject to the condition that the petitioner files the requisites for issuance of notice upon the opposite party no. 2 through ordinary process within one week from the date of the said order.
It has been reported by the office that despite the order dated 17.01.2019, the requisites for issuance of notice upon the opposite party no. 2 has not been filed on behalf of the petitioner.
Mr. H.K.Shikarwar, learned counsel for the petitioner, on instruction, does not want to press the restoration petition.
Learned A.P.P. has no objection for the same.
Accordingly, The present Cr.M.P. is dismissed as ‘not
pressed’.
The order dated 17.01.2019 is hereby recalled.
