Heard Mrs. Nivedita Kundu, counsel appearing on behalf of the petitioner.

2. Counsel for the petitioner submits that the petitioner is in custody since 15.04.2018 in connection with Tamar P.S. Case No. 34 of 2018, corresponding to G.R. No. 2171 of 2018 (S.T. No. 449 of 2018) for the offence registered under Sections 324, 325, 326, 307, 341, 342, 364/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Counsel for the petitioner submits that the bail application of the petitioner was rejected earlier vide order dated 08.08.2019 in B.A. No. 6793 of 2019. She submits that the petitioner has renewed his prayer for bail on account of the fact that some of the accused have been subsequently enlarged on bail by coordinate Bench of this court. She submits that informant of this case has already been declared hostile.

4. Learned counsel appearing on behalf of the State submits that the case of the petitioner was rejected on merit considering the allegations made against the petitioner and so far as informant is concerned, although he has been declared hostile but he has supported the incident.

5. Considering the facts and circumstances of this case, this court finds that the case of the petitioner was earlier rejected on

merit and therefore this court is not inclined to enlarge the petitioner on bail. Accordingly, prayer for bail of the petitioner is hereby rejected.

6. However, the learned court below is directed to expedite the trial of the petitioner.
