Petitioners are accused in Telco P.S. Case No. 172 of 2018, registered for the offence under Sections 379, 411, 34 of the Indian Penal Code, lodged on the basis of one written report given by Anil Kumar Singh, alleging that he is employee of Tata Motors Security Department as a security personnel and on 28.11.2018, he along with Tapan Kumar Mahto was on duty and at about 13:00 hours a bus bearing registration no. JH05BS-1029 coming out of the company gate and in course of search, he found four pieces of Super Spray com paint and 16 numbers of super spay com plaint and one fuel injection.

Learned counsel for the petitioners submitted that petitioner no. 1 is the driver and petitioner no. 2 is Khalasi of the seized vehicle bearing registration no. JH05BS-1029 and petitioners have got no criminal antecedent and they are in custody since 29.11.2018.

Learned A.P.P. opposed the prayer for bail.

Be that as it may, I am inclined to admit the petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Jamshedpur, in connection with Telco P.S. Case No. 172 of 2018 and subject to the further condition that one of the bailers shall be close relative of the petitioners and till framing of charges, petitioners shall be physically present in the court below on each and every dated fixed by the court below, failing which, the court below is at liberty to cancel the bail of the petitioner.
