Petitioner is accused in Pipra P.S. Case No. 29 of 2018, corresponding to G.R. No. 1182 of 2018, registered for the offence under Sections 302, 201, 120 (B) of the Indian Penal Code, lodged on the basis of fardbeyan of Sakunti Devi recorded by S.I. Basudev Munda, Officer-in-charge, Pipra P.S. on 19.05.2018.

Learned counsel for the petitioner submitted that the allegation against the petitioner is destroying the evidence, so offence under Section 302 of the I.P.C. is not made out and at best offence under Section 201 of the I.P.C. is made out. It is further submitted that petitioner is aged about 60 years.

In this case, FSL report has been received. It appears that the DNA profile generated from the source is positive gauze piece cuttings of Sakunti Devi is from the human female source of origin.

Supplementary affidavit has been filed on behalf of the petitioner bringing on record the order dated 02.04.2019, whereby charges have been framed under Sections 302/201/34 of the I.P.C. against the petitioner and coaccused.

Be that as it may, keeping in view the fact that charges have been framed and trial will take some time, I am inclined to admit the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned CJM, Palamau, in connection with Pipra P.S. Case No. 29 of 2018, corresponding to G.R. No. 1182 of 2018 subject to the condition that petitioner shall deposit Rs. 1,500/- by way of cost in the account of Army Welfare

Fund Battle Casualties being A/C No. 90552010165915, IFSC Code – SYNB0009055, Syndicate Bank, Branch – South Block, Defence Headquarter, New Delhi, Branch Code – 9055 and will submit a receipt of the aforesaid deposition before the court below at the time of furnishing bail bonds.
