The petitioners, who are accused for the offence under Sections 341/323/342/307/34 of the Indian Penal Code, have prayed for anticipatory bail expressing apprehension of their arrest in connection with Giridih(M) P.S. Case No.67 of 2018, corresponding to G.R. No. 594 of 2018.

Learned counsel for the petitioners has submitted, that there is free fight between the parties and it is alleged that, these petitioners without having specific allegation have assaulted the informant by means of tangi and rod, on the head and other parts of the body, causing bleeding injury.

Learned counsel for the petitioners has submitted, that during the investigation, the Investigation Officer has obtained the injury report and as per the injury report all these injuries are found to the simple in nature. Apart from that from the materials collected during investigation, it appears that a quarrel took place between both the parties.

Under the aforesaid circumstances, the petitioners may be enlarged on anticipatory bail.

Learned counsel for the State, Mr. Anjani Kumar Toppo, Additional Public Prosecutor has opposed the prayer for anticipatory bail on behalf of the petitioners on the ground that, because of assault made by the petitioners, the informant has sustained as many as five injuries, though the injuries are simple in nature, caused by hard and blunt substances and as such, the anticipatory bail application of the petitioners may be rejected.

Heard, learned counsel for the petitioners and leaned counsel for the State. Perused the case diary and the injury report mentioned in the paragraph-16 of the case diary. From perusal of the same it appears that both side have quarrelled and thus injury has been caused upon the informant, which is simple in nature. No specific role has been attributed against any of the petitioner.

Under the aforesaid fact and circumstances, the petitioners namely, Teko Das @ Teklal Das, Charka Das, Tulsi Das @ Rajendra Kumar Das, Pappu Das @ Papu Das, Pushpa Kumari and Mohini Devi are directed to be released on bail in the event of their surrender/arrest within four weeks from today, on furnishing bail bonds of Rs.10,000/-(Rupees Ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Giridih in connection with Giridih(M) P.S. Case No.67 of 2018 corresponding to G.R. No.594 of 2018. Subject to the conditions as laid down under section 438(2) Cr.P.C.
