The six petitioners, who are accused for the offence under Sections 448/323/324/325/307/354A/427/379/504/506/34 of the Indian Penal Code, have prayed for bail expressing apprehension of their arrest in connection with Devipur P.S. Case No.59 of 2018, corresponding to G. R. No.673 of 2018, pending in the court of learned Judicial Magistrate, Deoghar.

Learned counsel for the petitioners has submitted that in the First Information Report there is omnibus allegation against thirteen named accused persons including these six petitioners. The victim, Juelkha Bibi has sustained one grievous injury on her head but even during investigation, it has not been alleged that who has assaulted the victim causing such injury.

Learned counsel for the petitioners has further submitted that from perusal of the case diary, it appears that there was pelting of stone at the place of occurrence, due to which victim has sustained injury.

Learned counsel for the State assisted by learned counsel for the informant has submitted that these petitioners have assaulted the victim causing grievous injury and they have also damaged the entire house of the informant as such, they may not be enlarged on bail.

Heard, learned counsel for the petitioners and learned counsel for the State assisted by learned counsel for the informant. Considering the nature of allegation, which is omnibus against all thirteen named accused persons. The petitioners are directed to be

released on bail in event of their surrender/arrest within four weeks from today, on furnishing bail bonds of Rs.10,000/-(Rupees Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Deoghar in connection with Devipur P.S. Case No.59 of 2018, corresponding to G. R. No.673 of 2018, subject to the conditions as laid down under section 438(2) Cr.P.C. However, the petitioners shall also co-operate in the investigation and shall physically present before the learned trial Court on each and every date till framing of charge.
