04/14.08.2019 Heard the learned counsel for the parties.
The petitioners are accused for the offences punishable under Section 307/323/324/341/504/34 of the Indian Penal Code.
The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. The alleged occurrence took place in spur of the moment and the petitioners had no intention to kill the informant. The injury report of the informant would suggest that the injury inflicted upon him has been found to be simple in nature. The petitioners are in judicial custody since 29.03.2019 and as such, they may be given the privilege of regular bail.
The learned A.P.P. as well as the learned counsel for the informant oppose the petitioners’ prayer for bail.
Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Garhwa in connection with Garhwa P.S. Case No. 124 of 2019.
