Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has committed no offence as alleged. Initially the first information report was lodged at the instance of the Deputy Commissioner, Latehar, alleging irregularities committed in Jatropha plantation under Mahatma Gandhi National Rural Employment Guarantee Act. It has been alleged that the petitioner being the Labour Inspector, Manika, District Latehar in connivance with the concerned N.G.O. and other government officer(s)/official(s) embezzled about Rs.7,67,500/-. The petitioner has now retired from service. It is further submitted that during entire investigation, the police has not verified the actual role of the petitioner in execution of the aforesaid work so as to implicate him in the present case. Co-accused- Ram Prawes Yadav and Santosh @ Satyendra Prasad Yadav, President and Secretary of the concerned N.G.O., respectively, have already been granted bail by a coordinate Bench of this Court vide order dated 20th October, 2014 in B.A. No.6552 of 2014. Another co-accused-Sadhana Jaipuriar has also been granted bail vide order dated 31st August, 2013 in B.A. No.6501 of 2013. The petitioner did not appear before the court below in time, as he had no knowledge about his implication in the present case, which allegedly surfaced during investigation. The petitioner undertakes that he will fully cooperate in the trial and will physically appear before the court below as and when required. As such, the petitioner who is in judicial custody since 21st January, 2019 may be given the privilege of regular bail.
