02/13.06.2019 Heard the learned counsel for the parties.

The petitioner is an accused in a case registered for the offence punishable under Sections 323/364-A/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. The petitioner has not been named in the F.I.R. His name has surfaced on the alleged confessional statement of co-accused. Though the present occurrence took place on 02.07.2013, yet the petitioner was remanded in this case on 20.11.2018 and since then, he is in judicial custody. Except the confessional statement of co-accused, the police has not collected any cogent evidence to connect the petitioner in the alleged occurrence. Several co-accused namely, Lalo Singh, Naresh Bhuiyan, Pradeep Kumar Singh, Arun Kumar Yadav @ Binod Yadav @ Miyadi and Arun Kumar Yadav @ Arun Yadav @ Miyadi have already been granted regular bail by different Benches of this Court. As such, the petitioner may be given the privilege of regular bail.

The learned A.P.P. opposes the petitioner's prayer for bail.

Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Koderma, in connection with S.T. No. 96 of 2018, subject to the condition that petitioner shall appear before the trial court on each and every date unless his physical appearance is exempted by specific order of the trial court for a particular date, failing which the trial court shall be at liberty to pass appropriate order in accordance with law.
