05/08.08.2019 Heard the learned counsel for the parties.

The petitioner is an accused for the offences punishable under Sections 413/414/419/420/467/468/471/120-B of the Indian Penal Code and Section 66 (B)(C)(D) of the Information Technology Act.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner has been roped in the present case merely on suspicion. There is alleged seizure of 3 mobile phones and one motorcycle from the possession of the petitioner. Though some messages were found in the message box and certain amount was found in the B-Pay Wallet App. of one of the mobile phones of the petitioner, yet during the investigation, it could not be surfaced as to in what manner the petitioner committed the alleged cyber-crime and who are the persons defrauded by him. The petitioner has no criminal antecedent as has been stated in paragraph-82 of the case diary. Except the seizure of the mobile phones, the police has not been able to connect the petitioner with the alleged offence. The petitioner is in judicial custody since 17.01.2019 and as such, he may be given the privilege of regular bail.

The learned A.P.P. opposes the petitioner's prayer for bail.

Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Giridih, in connection with Giridih Cyber P.S. Case No. 05 of 2019.
