03/08.08.2019 Heard the learned counsel for the parties.
The petitioners are accused for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. The petitioners have been roped in the present case merely on suspicion as the deceased (sister of the informant) was staying with the petitioner no. 1 in the village of the petitioners for the last 8 – 9 months. During the entire investigation, the police has not been able to collect any cogent material to connect the petitioners with the alleged offence. As such, the petitioner no. 1 and the petitioner no. 2 who are in judicial custody since 25.01.2019 and 15.01.2019 respectively may be given the privilege of regular bail.
The learned A.P.P. opposes the petitioners’ prayer for bail.
Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gumla in connection with Ghaghra P.S. Case No. 07 of 2019.
