Learned senior counsel appearing for the petitioner drawing attention of this Court towards para-2 of the supplementary affidavit dated 04.09.2019, submits that the petitioner has filed the entire documents to show that the petitioner has paid Rs.9,28,34,950/- to the depositors of the said Smartway Trading and Marketing Pvt. Limited and at present there is no other claimants to claim that his or her money has not been paid. It is submitted that the allegation against the petitioner is false. It is then submitted that on similar facts also, a case was instituted against the petitioner and others who have been acquitted vide judgment dated 19.01.2015 by the Chief Judicial Magistrate, Latehar in Latehar P.S. Case No.132 of 2012 wherein after trial, the petitioner along with co-accused have been acquitted and in this case also, since the petitioner has all along co-operated with the investigation of the case hence the C.B.I. did not feel it necessary to arrest the petitioner. It is also submitted that no fruitful purpose will be served by denying the prayer for anticipatory bail of the petitioner. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
