[ Heard learned counsel for the parties.

Petitioner is an accused in a case registered for the offences punishable under Sections 341/342/323/354/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act, 2012.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It has been alleged that the petitioner along with co-accused Gappu Mian @ Gulam Rasul @ Gappu Miya outraged the modesty of the victim. However, similarly situated co-accused Gappu Mian @ Gulam Rasul @ Gappu Miya has already been granted regular bail by a Bench of this Court vide order dated 25.01.2019 passed in B.A. No. 9656 of 2018. The victim has already been examined in the trial as P.W.1. As such, the petitioner, who is in judicial custody since 27.04.2018, may be given the privilege of regular bail.

Learned A.P.P. opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/(rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I- cum Special Judge,POCSO, Dhanbad, in connection with Putki (Bhagabandh O.P.) P.S. Case no. 35 of 2018 corresponding to G.R. Case no. 1489 of 2018 [Special (P) Case no. 41 of 2018], subject to the condition that the petitioner shall co-operate in the trial and shall appear before the trial court on each and every date fixed in the trial till conclusion of the same unless his physical presence is exempted by specific order of the trial court for a particular date, failing which the said court is at liberty to pass appropriate order against the petitioner in accordance with law.
