Petitioner is accused in Ghaghra P.S. Case No. 105 of 2018, registered for the offence under Sections 414/34 of the Indian Penal Code and Section 11 (gha)(d) of Animal Cruelty Act, 1960.

It appears that four Kara were seized.

Learned counsel for the petitioner submitted that from definition of “Bovine Animal” in terms of Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005, means and includes cow, calf, heifer, bull or bullock and Kara is not a bovine animal.

Learned A.P.P. opposed the prayer for bail.

Be that as it may, I am inclined to admit the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Gumla, in connection with Ghaghra P.S. Case No. 105 of 2018, subject to the following conditions that :

(i) On the date of furnishing bail bonds, petitioner shall deposit Rs. 4,000/- in the court below, which shall be subject to the result of the case and will not prejudice the case of the petitioner during trial.

(ii) Petitioner shall deposit Rs. 1500/- by way of cost in the account of Army Welfare Fund Battle Casualties being A/C No. 90552010165915, IFSC Code – SYNB0009055, Syndicte Bank, Branch – South Block, Defence Headquarter, New Delhi, Branch Code – 9055 and will submit a receipt of the aforesaid deposition before the court below at the time of furnishing bail bonds.

Let a copy of order be also communicated to the trial court and also handed over to learned counsel for the petitioner.
