The petitioner has been made accused for the offence under Sections 494/498a/307/302/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that wife of the petitioner has died natural death and petitioner is innocent and has committed no offence as alleged in the FIR. Hence, petitioner deserves bail.

Learned APP has opposed the prayer for bail.

It appears that the deceased was suffering from mental disease and she was being treated in CIP, Kanke, Ranchi. It further appears that she was blessed with son but her one son is suffering from Thalassemia. It also appears that with the consent of the deceased, petitioner has solemnized second marriage.

From perusal of the postmortem report, it appears that the doctor has found no external injury on the body of the deceased and the time elapsed since death is 12-24 hours.

Be that as it may, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five Thousand) with two sureties of like amount each to the satisfaction of JM Ist Class, Seraikela, in connection with Rajnagar P.S. Case No. 65/201, subject to the condition that one of the bailers must be local resident of Seraikela district and subject to the further conditions as follows :

(1) Petitioner is directed to remain physically present before the trial court as and when his presence is required, till conclusion of trial and will cooperate in the trial, failing which the trial court will be at liberty to cancel the bail bonds of the petitioner.

(2) Petitioner is further directed that alongwith the bail bonds, he will furnish his Cell Number and xerox copy of AADHAR Card in the court below.

(3) Further, petitioner shall deposit Rs. 2,500/ - by way of cost in the account of Army Welfare Fund Battle Casualties being A/C No. 90552010165915, IFS Code no. SYNB0009055, Syndicate Bank Branch, South Block, Defence Headquarter, New Delhi, Branch Code:9055 and will submit a receipt of the said deposit before the the trial court at the time of furnishing of bail bonds.
