The petitioner is an accused for offence under Sections 302/307/324/ 326/34 of the Indian Penal Code, prays for regular bail in connection with B.S. City P.S. Case No. 48 of 2018 .
Learned counsel appearing for the petitioner has submitted that name of the petitioner got transpired, as co-accused, Ranjit Kumar, who was apprehended at the spot, has confessed his name as well as name of other co-accused persons, namely, Jitendra Kumar etc. The co-accused, Jitendra Kumar and Chandan Kumar Ray @ Chandan Kumar Roy have already been enlarged on regular bail vide order dated 27.08.2018 passed by a Co-ordinate Bench of this Court in B.A. No.5883 of 2018 with B.A. No.5660 of 2018.
Learned counsel appearing for the petitioner has further submitted that petitioner has surrendered on 06.12.2018 and since then he is in custody.
Learned counsel for the State while opposing the prayer for bail, has not disputed the factual aspect of the matter.
Considering the submissions of the parties and considering the co-accused persons have already been enlarged on regular bail by a Co-ordinate Bench of this Court, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bokaro, in connection with B.S. City P.S. Case No. 48 of 2018, corresponding to G.R. No.245 of 2018 , with condition that the petitioner shall remain physically present on each and every date till conclusion of the trial before the learned trial court.
