The petitioner is an accused for offence under Sections 406, 409, 120-B of the Indian Penal Code, prays for regular bail in connection with Sadar P.S. Case No. 94 of 2012 .
Learned counsel appearing for the petitioner has submitted that petitioner is neither President nor Secretary of the organization rather he is a member of Executive Committee and he cannot be fastened in misappropriation of a sum of Rs.56.91 Lac.
Learned counsel appearing for the petitioner has submitted that the petitioner is in custody since 07.10.2018, as such, he may be enlarged on bail.
Learned counsel for the State while opposing the prayer for bail, has submitted that the petitioner is active member of the Committee and a huge sum of Rs.56.91 Lac. has been misappropriated.
Considering the rival submissions of the parties, as a sum of Rs.56.91 Lac. has been misappropriated in connivance with the petitioner, I am not inclined to grant bail to the petitioner and hence, the prayer for bail is hereby rejected.
However, learned trial court is directed to expedite the trial.
