Heard learned counsel for the parties.

The petitioner is an accused in a case registered for the offence punishable

under Sections 406/420/467/468/471/34 IPC.

Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected by this Court vide order dated 29.06.2017 passed in B.A. No. 9652/2016. By way of present bail application, the petitioner has renewed his prayer for regular bail primarily for the reason that the petitioner is in judicial custody since 20.05.2016 and excluding the period of the provisional bail granted to him, he has remained in judicial custody in connection with the present case for about two years and nine months. It is further submitted that no witness was examined till passing of the impugned order dated 03.01.2019. As such, at least considering the length of judicial custody, the petitioner may be given the privilege of regular bail.

Learned A.P.P opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case and also the length of judicial custody, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamshedpur in connection with Bistupur P.S. Case No. 99/2015, corresponding to G.R. No. 1279/2015, subject to the condition that the petitioner shall co-operate in the trial and shall be present as and when required by the Court, failing which the Trial Court is at liberty to pass appropriate order against the petitioner in accordance with law.
