of Khata no. 12, plot no. 51 measuring an area of 1.20 acres being Khewat no. 1/2 along with some other land fell in the share of the grandfather of the petitioners namely Late Harihar Pandey who was the ex-landlord. Late Harihar Pandey filed return under Section 3B of the Bihar Land Reforms Act, 1950 (in short “the Act, 1950”) showing the land of plot no. 51 measuring an area of 1.20 acres in his cultivable possession. In ‘Bujharat’ also, Late Harihar Pandey-the exlandlord was found in cultivable possession of only 75 decimals of the land of Khata no. 12, plot no. 51 of village Dharampur (in short “the said land”). After vesting, Late Harihar Pandey was recognized as the raiyat of the said land. The petitioner nos. 1 and 2 being the heirs of Late Harihar Pandey have been in continuous joint possession of 75 decimals of land for which rent receipts were also issued to them till the year 2016-17 on payment of rent. However in the month of April, 2017, the petitioners noticed that some construction work was going on over the said land and on query, it was disclosed to them vide letter dated 09.08.2017 issued by the respondent no. 4 that the land measuring an area of 5 acres of plot no. 51 including the part of the petitioners’ land has been transferred by the respondent no. 5 to the respondent no. 3 by reasons of his order dated 03.02.2016 for the purpose of construction of Women’s College under Nilambar Pitambar University, Medininagar treating the said land as ‘Gair Mazurwa Khas’ land.
