The counsel for the petitioner submits that in Sessions Trial No. 135 of 2018, the petitioner has been put on trial, but due to inadvertence, the same was mentioned in Bail Application (B.A. No. 2569 of 2018) as S.T. No. 382 of 2017.
Counsel for the petitioner has produced some document i.e. status report of the trial court concerned, which suggests that there are two Sessions Trial pending in connection with Mango P.S. Case No. 149/2017. The document, which the petitioner has obtained from the website, suggests that the petitioner is facing trial in S.T. No. 135 of 2018 arising out of G.R. No. 1401/2017(S).
Taking into consideration the aforesaid document, this Cr.M.P. is allowed. Accordingly, the counsel for the petitioner is permitted to make necessary correction in para 1 and prayer portion of the bail application i.e. in B.A. No. 2569/2018 in course of the day.
Consequently, the order dated 23.4.2018 passed in B.A. No. 2569 of 2018 is modified to the extent that “ Session Trial No. 135 of 2018” be read in place of Session Trial No. 382 of 2017.
