MD Kamal Ansari Alias Kamal Ansari Vs the State of Jharkhand

The petitioner is an accused for the offence punishable under sections 498A, 323 of the Indian Penal Code and under section 3/ 4 of the Dowry Prohibition Act.

Inspite of valid service of notice, opposite party no.2 did not appear, so this case was ordered to be listed under the heading for admission in absence of the opposite party no.2.

The petitioner is the husband. There is a general allegation of demand of dowry and torture. This case arises out of the complaint. The petitioner has remained in custody since 10.01.2018 till the date he was granted provisional bail vide order dated 26.03.2018 and there is no allegation of misuse the privilege of provisional bail granted to the petitioner.

Taking into consideration the fact that this case arises out of the complaint and this petitioner has remained in custody for about 2 months and there is no of misuse the privilege of provisional bail, I am inclined to allow this application. Accordingly, the provisional bail granted to the petitioner vide order dated 26.03.2018 in connection with Complaint Case No. 3471 of 2015, pending in the Court of Sri Surendra Bedia, J.M. 1^st Class, Dhanbad, is made absolute.
