Parimal Pujhar Vs The State Of Jharkhand

Petitioner has been made accused for the offences under Sections 147/148/149/324/307/302/332/333/353 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of the CLA Act and Section 13 of the UAP Act, in connection with Kathikund P.S. Case No.45 of 2010, corresponding to G.R. No.1117 of 2010, S.T. No.60 of 2011.

There was an encounter between the police party and the members of the extremists group, in which, one police personnel was killed and others were injured. Earlier the bail application of this petitioner was rejected on merits by order dated 05.05.2015 in B.A. No.486 of 2015.

Learned counsel for the petitioner has renewed the prayer for bail submitting that the petitioner is in custody since 1.2.2014, and the similarly situated other co-accused have been granted bail by order dated 25.07.2016 in B.A. No.314 of 2016, as also in other cases, in which, even the persons, who were apprehended at the spot, have been granted bail. The petitioner was not apprehended at the spot.

In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner Parimal Pujhar is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-VI, Dumka, in connection with Kathikund P.S. Case No.45 of 2010, corresponding to G.R. No.1117 of 2010, S.T. No.60 of 2011.
