Petitioner is apprehending his arrest in connection with Pakuria P.S. Case No. 70 of 2017, corresponding to G.R. No. 769 of 2017, registered under Sections 379 / 411 of the I.P.C., Rule 54 of the JMMC Rules, 2004, Rule 6 of the JMD Rule, 2007, JTCR, 2005 Rule 3, JMDR 2007 Rule 9.

It is submitted by learned counsel for the petitioners that from perusal of the impugned order, it appears that the fine amount has been deposited by petitioner no. 1, who is owner of the seized vehicle in the Mining Office at Pakur.

Learned APP has opposed the prayer for anticipatory bail.

Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1^st Class, Pakur, in connection with Pakuria P.S. Case No. 70 of 2017, corresponding to G.R. No. 769 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
