3/02.02.2018 Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has been made accused for the offences under Sections 419, 420, 409 and 120-B of the Indian Penal Code, in connection with Karmatar P.S. Case No.10 of 2015, corresponding to G.R. No.89 of 2015.
Petitioner is an employee of Unmatched Systems Pvt. Ltd., which was entrusted with the work of loading cash in the ATMs of Banks. There is allegation against the petitioner to have committed theft of Rs.22,00,000/-, which was entrusted to him for loading in the ATM. Earlier bail applications of the petitioner were rejected on merits twice.
Learned counsel for the petitioner has renewed the prayer for bail submitting that the petitioner is in custody since 20.1.2015.
In the facts and circumstances of the case and taking into consideration the period of custody of the petitioner, I am inclined to release the petitioner on bail. Accordingly, the petitioner Jwala Prasad Singh @ Jawala Prasad Singh is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Sri Manoranjan Kumar-I, learned Judicial Magistrate, 1st Class, Jamtara, or his successor, in connection with Karmatar P.S. Case No.10 of 2015, corresponding to G.R. No.89 of 2015.
