The petitioner is apprehending his arrest in connection with Complain Case No. 29 of 2017 for the offence under sections 498A , 379 of the Indian Penal Code and

under section 3/4D.P. Act.

Pursuant to order dated 04.04.2018, both the parties are physically present along with learned counsel before this Court and in their presence possibility of reconciliation has been explored.

Petitioner became agree to pay Rs. 2,500/- per month of the O.P. No. 2 as interim maintenance from the month of June, 2018.

In these circumstances, I am inclined to admit the petitioner anticipatory bail on the following conditions;

(a) By way of interim maintenance, the petitioner will give Rs. 2,500/- per month to his wife-informant from month of June, 2018.

(b) The petitioner is directed to deposit the arrears as interim maintenance before the Trial Court for the month of June, & July, 2018 (Total Rs, 5,000) latest by 24.07.2018 .

(c) Further the informant is directed to appear through learned counsel and file application before the Trial Court and the Trial Court after proper verification release the said amount in her favour.

(d). The trial court in association with Secretary, D.L.S.A. Kodrema is directed to get the bank account of the O.P. No. 2 be opened in any nationalized bank under Pradhanmantri Jan Dhan Yojna by noticing her thereafter it will be duty of the trial court that from the month of August, 2018 the aforesaid maintenance amount would be directly deposited by the petitioner in the newly opened bank account of O.P. NO. 2.

(e) The petitioner is directed to deposit the said amount on or before 25th day of every month.

(f) If the petitioner fails to deposit the aforesaid amount for two consecutive months, the informant is at liberty to file application for cancellation of bail of the petitioner before this Court through learned counsel.

(g) Deposition of amount as interim maintenance would be subject to result of any order passed by the competent court of jurisdiction.

(h) It is expected that both the parties shall co-operate in the case for its expeditious disposal.

In view of above, the petitioner is directed to surrender in the Court below within five weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned S.D.J.M, Koderma in connection with Complain Case No. 29 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Let a copy of this order be communicated through 'FAX' to the concerned Court and to the Secretary, D.L.S.A. Koderma.
