Petitioner is an accused for allegedly committing the offence punishable under Sections 302/34 of the Indian Penal Code in connection with Burmu Police Station Case No.05 of 2013 corresponding to G.R. No.415 of 2013, pending in the Court of learned Judicial Magistrate 1^st Class, Ranchi.

This is a case of murder. There is one eye witness, namely, Anju Devi. Her statement has been recorded under Section 164 of the Code of Criminal Procedure, where she has stated that she has seen one person committing murder of the deceased by using a fire arm. Said Anju Devi is a chargesheet witness. It is high possibility that she may identify the accused while deposing in the Court.

Taking into consideration the aforesaid facts since the eye witness, Anju Devi, is yet to be examined, I am not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of the petitioner, namely, Mahavir Pahan, in connection with Burmu Police Station Case No.05 of 2013 corresponding to G.R. No.415 of 2013, pending in the Court of learned Judicial Magistrate 1^st Class, Ranchi, is hereby rejected.
