Petitioners are apprehending their arrest in connection with Namkum P.S. Case No. 225 of 2016, corresponding to G.R. No. 5104 of 2016, registered under Sections 420, 467, 468, 471, 34 of the I.P.C.

Learned counsel for the petitioners submitted that the FSL report of the seized computer and CPU have been received and is kept at Flag-'R', but it does not suggest any incriminating material against the petitioners. The petitioners have fully cooperated in the investigation of the case. So, the petitioners deserve the privilege of anticipatory bail.

Learned APP has opposed the prayer for anticipatory

Be that as it may, I am inclined to admit the petitioners on anticipatory bail on following conditions:-

(i) Petitioner – Rohit Raman is directed to deposit Rs. 1,00,000/- and petitioner – Vikash Kumar is directed to deposit Rs. 25,000/- before the President / Secretary, Jharkhand High Court Advocates' Association, Ranchi as cost on or before 03.04.2018. On deposition of amount by the petitioners, the President will issue receipt to them. The amount will be utilized only for the welfare of learned Members of the Jharkhand High Court Advocates' Association.

(ii) After deposition of the aforesaid amount, the above named petitioners are directed to surrender in the Court below on or before 09.04.2018 and in the event of their arrest

or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 15,000/(Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ranchi, in connection with Namkum P.S. Case No. 225 of 2016, corresponding to G.R. No. 5104 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further on the date of surrender, petitioners shall file the receipt of the aforesaid deposition in the court below.

(iii) Petitioners are further directed that along with the bail bonds, they will furnish their Cell numbers and xerox copy of AADHAR Cards in the court below. (iv) Petitioners are directed to give undertaking that they will join in investigation. (v) It shall be open for the I.O. of this case that if he wants to record the statement of the petitioners, he will file an application through APP and the court below shall release the Cell Numbers of the petitioners to the I.O., thereafter the I.O. will give 72 hours' notice to the petitioners fixing date, time and place and, thereafter, petitioners will appear and get their statement recorded. If petitioners fail to do so, then the I.O. will be at liberty to file application through APP for cancellation of bail bonds of the petitioner.

Let a copy of order be communicated to the court below an also to the President/Secretary, Jharkhand High Court Advocates' Association, Ranchi and also handed over to the learned APP for transmission to the I.O.
