1) This C.M.P. has been preferred for restoration of First Appeal No.59 of 2013.
2) Having heard learned counsel for the applicant (original appellant) and looking to the facts and circumstances of the case, it appears that the defects were not removed in First Appeal No.59 of 2013 and hence, the same was dismissed.
3) We, therefore, recall the order passed by this Court dated 17.10.2013 and time to remove the defects in First Appeal No.59 of 2013 is granted for two weeks from today.
4) If the defects in First Appeal No.59 of 2013 are not removed within further two weeks from today, again this First Appeal shall be deemed to have been dismissed automatically. However, if the defects are removed, Registry is directed to enlist First Appeal No.59 of 2013 as per roster on 10th September, 2018.
5) This C.M.P. is allowed and disposed of.
