Sunil Kumar Mandal Vs the State of Jharkhand

The petitioner is an accused for allegedly committing an offence punishable under Sections 419/420/467/468/471/120(B) IPC & u/s 66( C) (D) of the IT Act in connection with Ahilyapur Police Station Case No. 73 of 2017 (G.R. No.3147 of 2017), pending in the Court of learned Sub-Divisional Judicial Magistrate, Giridih.

It is alleged that petitioner by fraudulent means transferred money electronically from bank account of several persons and misappropriated the same.

Counsel for the petitioner submits that mobile has been recovered from his possession. Save and except the said recovery there is nothing against this petitioner.

Learned A.P.P. opposes the prayer for bail and submits that petitioner has confessed his guilt and mobile was recovered from his possession. The CDR suggests that several calls have been made from the seized mobile phone and after going through the case diary he admits that there is no criminal antecedent of the petitioner and there is nothing in the case diary to suggest that money was transferred electronically.

Keeping in view of the aforesaid submission of the learned APP, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Giridih in connection with Ahilyapur Police Station Case No. 73 of 2017 (G.R. No.3147 of 2017).
