In view of the resolution dated 4.5.2018 taken by the Advocates' Association, High Court of Jharkhand, none appears today.
I have gone through the case and it is possible to dispose of this bail application in absence of the counsels.
The petitioner is an accused for allegedly committing an offence punishable under Sections 216 IPC, Section 25(1-B)a, 26,35 of the Arms Act and Section 17 of the CLA Act.
It is alleged that this petitioner and others have assembled for committing crime. Admittedly, there is no recovery from the possession of this petitioner and he was also not arrested from the spot.
In view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Gumla in connection with Palkot Police Station Case No. 43 of 2016 (G.R. No. 834 of 2016).
