Heard the learned counsel for the parties.
The petitioner is an accused for the offence under Sections 363, 366/34 of the Indian Penal Code.
The father in-law of the victim states that the victim left her house along with some gold ornaments and money. Later on, one Aslam Ansari informed that the victim was seen at the Railway Station and this petitioner was also seen. From the record, it is apparent that the petitioner and the victim belong to same village the and victim left her house with money and jewelleries.
Counsel for the petitioner submits that the victim was known to the petitioner prior to marriage and there was some relationship between them, as a result of which, the victim left her house.
After going through the record, I find force in the submission of the counsel for the petitioner. Accordingly, the petitioner, namely, Vikash Mandal @ Shashi Prasad, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Hazaribagh in connection with Barhi P.S. Case No. 124/2016, corresponding to G.R. No. 1481/2016.
