The petitioners are accused for the offence punishable under sections 147, 148, 149, 341, 323, 324, 326, 302 and 120B of the Indian Penal Code.
Learned counsel for the petitioners submit that the entire allegation is because of land dispute between the informant and the petitioners which is apparent from the F.I.R. The allegation against the petitioners is general and omnibus in nature and similarly situated coaccused persons have been granted bail by this Court in B.A. No. 1172 of 2018.
Learned A.P.P. opposes the prayer for bail, but admit that no overt act has been attributed to these petitioners in committing murder of two of the deceased.
Keeping in view of the aforesaid submissions made by the learned A.P.P., I am inclined to release the petitioners on bail. Accordingly, the petitioners, namely, 1. Mangal Hansda @ Mangal Handsda and 2. Pandu Hansda are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sahibganj, in connection with Barhait P.S. Case No. 39 of 2017, corresponding to G.R. No. 426 of 2017.
