4/19.09.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.

The petitioner is an accused for allegedly committing offence punishable under Sections 147, 148, 149, 353, 325, 427, 504,506, 452, 435, 332, 333 of the Indian Penal Code.

The petitioner is not named in the F.I.R. This is a case where mob has assaulted two persons on the allegation that they were child lifters.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name transpired from the confessional statement of the co-accused persons. He submits that the petitioner is in custody since 10.08.2018.

Taking into consideration the aforesaid submission of the learned counsel for the petitioner and the period of custody, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Prasant Jyotishi is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Seraikella in connection with Rajnagar P.S. Case No. 29 of 2017 [G.R. No. 506/2017], subject to the condition that the petitioner shall deposit a sum of Rs. 10000/- (ten thousand only) in the account of “ Kerala Chief Minister’s Distress Relief Fund (Account No. 67319948232, State Bank of India, City Branch, Thiruvananthapuram, having IFSC: SBIN0070028 / SWIFT Code SBININBBT08) ”, which is an account of State Government of Kerala, meant for helping the affected persons of recent floods in Kerala and will furnish a proof of such deposit at the time of furnishing bail bonds before the Court below.
