Names of the petitioners have come from the statement of one Santoshi Kumari, who has stated that the deceased was taken by these petitioners and others and was assaulted by them by Lathi and Danda.

Counsel for the petitioner submits that both witness i.e. Santoshi Kumari and her father, Galu Munda, who happen to be eye witness have turned hostile.

Taking into consideration the aforesaid fact that the witnesses who claim to be eye witnesses to the said occurrence, have turned hostile, I am inclined to release the petitioners on bail. Accordingly, the petitioners, namely, 1. Baday Sawansi @ Barai Sawansi @ Baday Swansi and 2. Lukun Sawansi @ Lukum Swansi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khunti, in connection with S.T. Case No. 144 of 2016, arising out of Khunti P.S. Case No. 63 of 2016, corresponding to G.R. No. 205 of 2016, subject to condition that the petitioners will appear before the trial Court on each and every date fixed in the case during the trial.
