4/18.04.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.

The petitioner is an accused for allegedly committing offence punishable under Sections 212, 216, 414 of the Indian Penal Code and Sections 17 (I) (ii) of the C.L.A. Act.

The petitioner is alleged to be the informer of the extremists’ organization. It is alleged that the extremists have given a motorcycle to this petitioner, which was recovered from his possession as the same was being used by this petitioner to inform about the movement of the police to the extremists.

This is the only allegation against this petitioner and he is in custody since 12.02.2018.

Taking into consideration the aforesaid fact, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Gurudutt Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Simdega in connection with Bano (Girda O.P.) P.S. Case No. 54 of 2017 [G.R. No. 397/2017], subject to the condition that the petitioner shall appear before the court below on each and every date so fixed in the trial and if he fails to appear even on a single date, his bail bonds shall stand cancelled and steps for taking him into custody shall be taken by the trial court.
