The petitioners are apprehending their arrest in connection with the case registered under Sections 302/34 of the IPC.
Learned counsel for the petitioner has submitted that the petitioners have been falsely implicated and the commission of murder is totally baseless as the son of the complainant died due to road accident. It is further submitted that there is land dispute between the parties.
It appears that after investigation police has submitted final form and found clueless and thereafter protest-cum-complaint petition has been filed.
In the facts and circumstances of the case, I am inclined to admit the petitioners on anticipatory bail. The petitioners are directed to surrender in the court below within four weeks and in the event of their arrest or surrender, the court below shall release them on bail on their furnishing bail bond of Rs.25,000/- Twenty Five Thousand) eacg with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Ramgarh, in connection with protest-cum-complaint Case No.389/12, arising out of Gola P.S. Case No.45 of 2010, corresponding to G.R.No.1771/10, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
