Heard the learned counsel for the parties.
Learned A.P.P opposes the prayer for bail.
The petitioner is accused for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
It is alleged that the petitioner along with others had assembled at the place of occurrence for committing dacoity.
Counsel for the petitioner submits that from the possession of the petitioner, one cartridge has been recovered. He further submits that the petitioner is in custody since 16.10.2017.
Taking into consideration the period of custody of the petitioner and the fact that the charge-sheet has already been submitted in this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Md. Aslam, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Godda, in connection with Lalmatia P.S. Case No. 76/2017, corresponding to G.R. No. 1420 of 2017.
