The petitioner is apprehending his arrest in connection with Deoghar (Kunda) P.S. Case No. 391 of 2005, corresponding to G.R. No. 1070 of 2005 for the offence under sections 468, 420, 413, 414, 34 of the Indian Penal Code.

It appears that under order dated 02.02.2018, entire case record of Deoghar (Kunda) P.S. Case No. 391 of 2005, corresponding to G.R. No. 1070 of 2005 was called for from the court concerned which has been received.

From perusal of L.C.R, it appears that on 27.07.2017, the learned C.J.M Deoghar took cognizance under section 413, 414/34 of the Indian Penal Code and summons was issued, Further, it appears that police after investigation submitted final form being Final Form NO. 76 of 2011 showing the complicity of the petitioner to be false, thereafter, learned C.J.M, Deoghar differing with the opinion of the I.O took cognizance against the petitioner under order dated 25.07.2011 and the said order has been challenged by the petitioner in Cr.M.P. NO. 687 of 2016 which was allowed with some observation vide order dated 12.01.2017.

In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of learned Ist Additional District Judge, Deoghar in connection with Deoghar (Kunda) P.S. Case No. 391 of 2005, corresponding to G.R. No. 1070 of 2005, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
