Petitioners are apprehending their arrest in connection with Complain Case No. 663 of 2016 for the offence under sections 467, 468, 471, 406, 420/34 of the Indian Penal Code but cognizance has been taken under sections 420/34 I.P.C.

Today, pursuant to order dated 13.08.2018 parties are physically present along with learned counsels and in their presence possibility of reconciliation has been explored, petitioner-Ramanand Kumar (A.B.A. No. 1250 of 2018) became agree to return the amount of Rs. 74,000/- to the informant.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court latest by 19.11.2018 and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 20,000/(Rupees twenty thousand)each with two sureties of the like amount each to the satisfaction of the court of learned S.D.J.M, Giridih in connection with Complain Case No. 663 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioner Ramanand Kumar (A.B.A. No. 1250 of 2018) is directed to deposit a bank draft of Rs, 74,000/- drawn in the name of informant on the date of his surrender thereafter the trial court will hand over the said bank draft to the informant

after making proper verification. The informant is directed to remain physically present

on 19.11.2018 before the trial court.
