02/04.01.2017: In this writ petition, the petitioner has prayed for a direction upon the

respondent authorities for payment of arrears of salary of the petitioner from 1.4.2013 to 30.9.2013.

The petitioner was appointed as Assistant Teacher and retired as Incharge Headmaster, Middle School, Hadari, Ichak, on 30.9.2013 after attaining his age of superannuation.

The counsel for the petitioner submits that the petitioner had worked during the period 1.4.2013 to 30.9.2013 but the salary of the said period has not been paid to the petitioner. Counsel for the petitioner further submits that he has represented before the District Superintendent of Education, Hazaribagh, but till date no action has been taken in this regard.

Counsel for the State submits that if a fresh representation is filed before the authority concerned, the case of the petitioner will be considered at the earliest.

In view of the statements made by the parties, I direct the petitioner to file a fresh representation before respondent No. 3 within six weeks from today and upon receipt of such representation, respondent No. 3 will pass a reasoned order after verifying the claim of the petitioner. If the petitioner is entitled to get the amount on account of arrears of salary, the same should be paid to the petitioner within twelve weeks from the date of receipt of the said representation. If the claim of the petitioner is declined in full or in part, the reasons, thereof, will be communicated to the petitioner within the said period.

The writ petition stands disposed of, accordingly.
