The petitioners, in this writ application, have prayed for payment of their arrears of salary alongwith all the consequential benefits w.e.f. 01.01.1989 to 14.11.2000.

It appears that petitioner Nos. 1 and 2 are the Peons of Project Girls' High School, Barhi, Hazaribagh, whereas, petitioner No. 3 is the peon of Project Girls' High School, Ichak, Hazaribagh. The services of the petitioners in their respective posts were approved by the Government vide Notification No. 424 dated 09.02.2011. The petitioners are getting regular salary but they are claiming arrears of salary.

Learned counsel for the petitioners submits that all the formalities have been completed but due to non-availability of fund, the amount has not been disbursed to the petitioners.

Learned counsel appearing for the State submits that the grievance of the petitioners will be looked into if the petitioners file a detailed representation.

In view of the submission made on behalf of the respondents, the petitioners are directed to file a representation claiming their arrears of salary before respondent no. 3-the Director, Secondary Education, Department of Human Resources, Govt. of Jharkhand, Ranchi, within six weeks from today. On receipt of such representation, respondent no. 3 will look into the grievance of the petitioners and will pass a reasoned order on the said representation. If any amount is found payable to the petitioners,

the same should be disbursed to them within a period of twelve weeks from the date of receipt of the representation. If any part of the claim of the petitioners is rejected, reasons thereof, should be communicated to them within the said period.

With this observation and direction, this writ application stands disposed of.
