06/04.12.2017 Heard Mr. Ashok Kr. Sinha, learned counsel for the petitioner and Mrs. Laxmi Murmu, learned A.P.P. for the State.

This application is directed against the order dated 05.01.2017 passed by learned Principal Judge, Family Court, Ranchi in Original Misc. Case No. 34/2013 by which the opposite party no. 2 has been awarded monthly maintenance of Rs. 2,000/- whereas the opposite party no. 3 has been awarded monthly maintenance of Rs. 1,000/-.

The only submission which has been made by the learned counsel for the petitioner is that the petitioner is an unemployed person and he doesn’t have any source of income rather he is dependent upon his parents for his livelihood. There is no dispute about the marriage of the petitioner having been solemnized with the opposite party no. 2. The petitioner is an able bodied person and it is his bounden duty to maintain his wife and child. The amount of maintenance of Rs. 3,000/(in total) is a reasonable amount considering the present day price index and in such view of the matter therefore no error is detected in the impugned order dated 05.01.2017.

Accordingly, having found no merit in this application, the same is, hereby, dismissed.
