Earlier prayer for bail of the petitioner was rejected on 13.06.2017 vide B. A. No. 3490 of 2017.
The petitioner is an accused in connection with Borio (J) P.S. Case No. 23 of 2017 registered for the offences punishable under Sections 354 of the I.P.C. and Section 4 of the POCSO Act, 2012.
It has been submitted by the learned counsel for the petitioner that the petitioner is in custody since 13.02.2017 and the allegation against the petitioner is of touching the private parts of the informant who is aged about 8 years.
Learned counsel for the State opposed the prayer for bail.
Considering the period of custody, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge I, Sahibganj in connection with S. T. No. 96 of 2017 arising out of Borio(J) P. S. Case No. 23 of 2017 corresponding to G. R. No. 52 of 2017.
